Terms of Service

These Terms of Service ("Terms") are an agreement between you and JMR Innovations LLC ("WIN," "we," "us," or "our") and govern your use of the WIN mobile app (the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the permission of a parent or legal guardian who agrees to these Terms on your behalf.

2. Your Account You sign up with an email address and password. You are responsible for keeping your password secure and for everything that happens under your account. Give accurate information and do not create an account for someone else or impersonate anyone.

3. Zero Tolerance for Objectionable Content and Abusive Users WIN has zero tolerance for objectionable content and abusive behavior. You may not post, comment, or include in your profile anything that: • harasses, bullies, threatens, intimidates, or targets any person • is hateful or discriminatory toward people based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, age, or any other protected characteristic • contains nudity, sexual content, or sexualizes minors in any way • depicts, promotes, or glorifies violence, self-harm, suicide, or eating disorders • promotes illegal activity, weapons, or illegal drugs • is spam, a scam, misleading, or commercial solicitation • impersonates another person or misrepresents who you are • shares someone else's private information without their consent • infringes anyone's copyright, trademark, privacy, or other rights You also may not use the App to abuse, stalk, or harass other users, to get around a block, or to create new accounts after we have removed you.

4. Reporting, Blocking, and How We Enforce These Terms • Report: you can report any post, comment, or user from inside the App. Reports are confidential; the person you report is not told who reported them. • Block: you can block any user. Blocking hides each of you from the other (profiles, posts, comments, and search) and removes any follows, likes, and comments between you. You can unblock people in Settings → Blocked accounts. • Review: we review reports within 24 hours. When content breaks these Terms, we remove it, and we remove the user who posted it from WIN by terminating their account. We may also remove content or accounts without a report. • Filtering: we automatically block some objectionable words and phrases in captions, comments, names, usernames, and bios. • Contact: you can also reach us about any safety concern at support@winapp.tech.

5. Your Content You own the photos, captions, comments, and profile information you post ("Your Content"). By posting it, you give us a worldwide, non-exclusive, royalty-free license to store, display, and distribute Your Content within the App, only so that we can operate the App and show Your Content to the people allowed to see it under your privacy settings. This license ends when you delete the content or your account. You are responsible for Your Content and confirm you have the right to post it.

6. Who Can See Your Content • Your username, name, bio, and profile photo can be seen by any signed-in WIN user who has not blocked you or been blocked by you. • If your account is public, your posts can be seen by any signed-in WIN user. If your account is private, only followers you approve can see your posts. • Comments you leave on someone's post can be seen by anyone who can see that post.

7. Daily Challenges and Physical Activity WIN suggests daily challenges to encourage healthy habits. Some involve physical activity. Use your own judgment, stay within your abilities, follow local laws, and consult a qualified professional before starting any new fitness or wellness activity. You take part in challenges at your own risk.

8. Our App The App, its design, challenges, and branding (excluding Your Content) belong to JMR Innovations LLC. You may not copy, modify, reverse engineer, or resell the App, or try to access other users' accounts, our servers, or data you are not allowed to see.

9. Deleting Your Account and Termination You can delete your account at any time in Settings → Delete account. Deletion is immediate and permanent; see the Privacy Policy for what is removed. We may suspend or terminate your account at any time if you break these Terms, including under section 3, or if required by law.

10. Disclaimers The App is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties of any kind, express or implied, and we do not guarantee the App will always be available or error-free. We are not responsible for content posted by other users, though we act on reports as described in section 4.

11. Limitation of Liability To the fullest extent permitted by law, JMR Innovations LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the App.

12. Changes to These Terms We may update these Terms. When we make a significant change, we will ask you to review and accept the updated Terms in the App before you continue using it.

13. Apple These Terms are between you and JMR Innovations LLC, not Apple Inc. Apple is not responsible for the App or its content and has no obligation to provide support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
